Welcome to the Background Info USA Affiliate Program. This program offers you the opportunity to earn commissions by referring new customers to our services. Please review these Terms and Conditions carefully, as they govern your participation. By enrolling, you agree to operate in compliance with all applicable laws and uphold ethical marketing standards.

1. DEFINITIONS
1.1 “Affiliate” or “You” means the individual or entity participating in the Affiliate Program.
1.2 “Company,” “We,” or “Us” means Background Info USA.
1.3 “Affiliate Program” means the program under which Affiliates promote our products and services.
1.4 “Commission” means compensation paid for qualifying referrals.
2. ENROLLMENT
2.1 Eligibility: You must complete the application and agree to these Terms.
2.2 Approval: We reserve the right to approve or reject any application at our sole discretion.
3. COMMISSIONS
3.1 Commission Structure: Affiliates earn 25% net commission on eligible services for the life of the account, provided the referred customer completes the order and submits full payment.
3.2 Non-Commissionable Items: Commissions are not paid on the following:
- Court fees
- DMV fees
- Employment or education verification fees
- Drug testing fees
- Social media search fees
- Credit reports
3.3 Payment Terms: Commissions are paid every 30 days via ACH in U.S. currency.
3.4 Minimum Payout: A minimum balance of $25 is required for payout. Balances below this amount will roll over.
3.5 Pricing Adjustments: If pricing must be discounted to secure a sale, we will notify you, as it may impact your commission.
3.6 Refunds: If a customer receives a refund, any associated commission will be deducted from your balance.
4. AFFILIATE RESPONSIBILITIES
4.1 Promotion: You agree to promote our services in a professional manner consistent with our brand and guidelines.
4.2 Compliance: You must comply with all applicable laws, including anti-spam, privacy, and intellectual property laws.
4.3 Ethical Conduct: All marketing must be truthful, transparent, and not misleading.
5. PROHIBITED ACTIVITIES
5.1 Fraud: Activities such as click fraud, cookie stuffing, or incentivized referrals are strictly prohibited and will result in immediate termination.
5.2 Trademark Use: You may not use our trademarks or branding without prior written consent.
5.3 Misrepresentation: You may not make false or misleading claims about Background Info USA or its services.
6. TERMINATION
6.1 Termination Rights: We may terminate your participation at any time for violation of these Terms.
6.2 Effect of Termination: Upon termination, unpaid commissions may be forfeited.
7. MODIFICATION OF TERMS
7.1 We may update these Terms at any time. Continued participation constitutes acceptance of any changes.
8. LIMITATION OF LIABILITY
8.1 Background Info USA is not liable for any indirect, incidental, or consequential damages arising from participation in the Affiliate Program.
9. GOVERNING LAW
9.1 These Terms are governed by the laws of the State of Florida.
